REGISTRATION

1. What is AR Direct?

AR Direct is a service providing its registered members a new means of vehicle acquisition directly from the various suppliers: insurance companies, wholesalers, donation companies, fleets, franchise dealers and others. AR Direct is the newest source for salvage, damaged, donation and other low end vehicles for the automotive industry.

2. How to become a member?

Simply fill out the registration form and supply required documents. We will process your application shortly.

BIDDING USING AR Direct

1. Do I have to agree to the terms of the User Agreement before I may bid?

Yes. To submit bids using AR Direct, you must agree to the AR Direct User Agreement ("User Agreement"), complete the buyer registration form, pay any applicable registration fees, as set forth in the Fee Schedule, and submit proof of identity (such as a valid driver's license), copies of current licenses and/or registrations, and completed sales tax exemption certificates to AR Direct. Please remember that by clicking the "SUBMIT" button you agree to the terms and conditions of the User Agreement. If you do not agree to the AR Direct User Agreement ("User Agreement"), you CANNOT register or place bids using AR Direct. You may view the User Agreement at any time at http://www.ar.direct/about-us/ar-direct-user-agreement.

Licenses must be renewed and submitted to AR Direct prior to expiration to maintain active buyer status. It is your sole obligation to maintain all requisite license(s) and registration(s) required for the purchase of vehicles, and to update your sales tax exemption certificate. Failure to maintain the appropriate license(s), registration(s), and/or certificate(s) may result in suspension or termination of your AR Direct membership.

2. How do I place a bid using AR Direct?

You may place bids online by signing into your AR Direct account. Bids may be placed during an online auction and the highest bid at the end of the online auction will be presented to the seller for approval, if applicable. Remember, all bids are active until the listing ends.

In some instances, a vehicle may be offered with a "buy now" option, and be available for immediate purchase. Once the sale is approved, the bidder is responsible to pay for and pick up within the specified timeframe.

Bidding eligibility is determined by state and local regulations and some states and/or localities may have additional requirements to bid on salvage vehicles. To be eligible to bid using AR Direct, you should verify you have met such additional requirements, if applicable. Please review state and local regulations to determine your bidding eligibility. 3. Will my bid be automatically updated if another bidder places a higher bid on a vehicle?

AR Direct uses an incremental bidding process for its online auctions. When you bid on a vehicle you are asked to enter the maximum price you are willing to pay for the vehicle. As the listing proceeds, we compare your bid to those of other bidders. When you are outbid, we automatically bid on your behalf up to your maximum bid. We increase your bid by fifty dollar ($50.00) increments only as necessary to maintain your position as highest bidder.

4. What does it mean if a vehicle is offered with a "reserve price"?

Some vehicles may be listed with a reserve price. A reserve price is the lowest price that the seller is willing to accept for the item. As a buyer, you are not shown the reserve price. If the listing ends without any bids that meet the reserve price, the seller is not required to sell the item.

5. May I change or retract my bid?

You may raise your bid on AR Direct by increasing your maximum bid amount at any time before the end of the listing. As a general rule, you are not allowed to retract or cancel a bid on AR Direct. When you place a bid, you agree to pay for the item if you are the winning bidder. Winning bidder agrees that their bid is binding for 60 days after the end of auction.

6. Can I buy a vehicle right away, without submitting a bid?

Some vehicles may be offered with a "buy now" option and are marked with "buy now" price. Only those vehicles specifically designated with a "buy now" option may be purchased without submitting a bid. All other vehicle must be purchased through the AR Direct bidding process.

7. What does my bid amount include?

When you bid using AR Direct, your bid amount covers the price of the vehicle only. AR Direct buyer fees and any seller fees (such as storage fees or loading fees, if applicable), transportation costs, etc. are not included in the bid amount. AR Direct fees are set out in out Fee Schedule and may vary based on the price of the vehicle.

AR Direct has no control over seller fees or shipping costs. It is your sole responsibility to verify any such fees prior to purchasing a vehicle or incurring such charges. Failure to pay any required fees, including AR Direct fees or seller fees, may result in suspension or termination of your AR Direct account.

8. May I visit the vehicle location to inspect a vehicle prior to purchase?

No. Vehicles offered for sale through AR Direct are NOT available for physical inspection prior to purchase. You should carefully review item images and descriptions provided by the seller before placing a bid.

9. Why was the AR Direct bidding deadline extended?

If a bid is received within the last five (5) minutes of the auction deadline, the bidding end time is automatically extended for an additional five (5) minutes. This feature has been implemented to allow the bidder with the previous highest bid to increase their bid before the end of the auction.

10. When will I be notified of the bid approval?

Customers with highest bid on the item with the reserve price are notified of the results by e-mail at the end of the auction. Additionally the results are posted under the 'My Account' section of your AR Direct account.

11. What do I do after I win?

When you win a vehicle, you should pay for and pick up the vehicle by the end of the first business day following the day of sale. For example, if you purchase a vehicle on Tuesday, you must pay for and pick up the vehicle by the end of the business day on Wednesday. If you purchase a vehicle on Friday, you must pay for and pick up the vehicle by the end of the business day on Monday.

Please note that you must pay for the vehicle before you may pick up the vehicle. The address of the vehicle will only be released to you after AR Direct has received full payment for the vehicle. We recommend you pay for your vehicle as soon as possible to allow time to arrange for vehicle pick-up.

If you fail to pay for or pick up your vehicle within the specified time, you will forfeit your right to purchase the vehicle, and your AR Direct account will be suspended. If you wish to continue using AR Direct, you will be required to pay a Reinstatement Fee. Please see the Fee Schedule for current Reinstatement Fees.

PAYMENT AND FEES

1. What forms of payment do you accept?

We accept credit card (Visa, MasterCard, or Discover) or PayPal payments as the preferred method of payment via AR Direct's online payment processing portal.

2. When must I pay for the car?

Purchases should be paid for by the end of the first business day following the day of sale via AR Direct's online payment processing portal. For example, if you purchase a vehicle on Tuesday, you must pay for the vehicle by the end of the business day on Wednesday. If you purchase a vehicle on Friday, you must pay for the vehicle by the end of the business day on Monday.

Please note that the address of the vehicle will only be released to you after AR Direct has received full payment for the vehicle. We recommend you pay for your vehicle as soon as possible to allow time to arrange for vehicle pick-up.

Failure to pay for an item within the specified time will result in suspension of your AR Direct account, forfeiture of your right to purchase the vehicle, and a Renege Fee.

3. What happens if I do not pay for my vehicle within the required time?

If you fail to pay for a vehicle by the end of the first business day following the day of sale, your AR Direct account will be suspended, you will forfeit your right to purchase the vehicle, and the vehicle will be re-listed for sale. In addition, you will incur a Renege Fee of not less than $1000.00 or 15% of your winning bid, whichever is greater.

For example, if you purchase vehicle on Tuesday, and fail to pay for the vehicle by the end of the business day on Wednesday, your AR Direct account will be suspended, you will forfeit your right to purchase the vehicle, the vehicle will be re-listed, and you will incur a Renege Fee. If you purchase a vehicle on Friday, and fail to pay for the vehicle by the end of the business day on Monday, your AR Direct account will be suspended, you will forfeit your right to purchase the vehicle, the vehicle will be re-listed, and you will incur a Renege Fee.

Once your AR Direct account is suspended, you may reinstate your account by paying a Reinstatement Fee. For current AR Direct Reinstatement Fees please see the Fee Schedule.

4. Will I be responsible for storage fees?

Any vehicle you purchase will be stored through the end of the first business day following the day of sale free of charge. For example, if you purchase a vehicle on Tuesday, your vehicle will be stored free of charge until the end of the business day on Wednesday. If you purchase a vehicle on Friday, your vehicle will be stored free of charge until the end of the business day on Monday. After that, the customer will incur a storage fee (including weekends), which will vary by facility.

Please note: Although you may not incur any storage fees if you pick up the vehicle on time, you may be required to pay Advance Fees before the vehicle will be released to you. Such Advance Fees will be reimbursed by AR Direct.

5. What are Advance Fees?

Advance fees may include storage, towing, tear down, gate fee, lot fee, administrative, or other fees the facility may charge for the vehicle while it is in their possession. You may be required to pay all Advance Fees before you are permitted to pick up your vehicle. We recommend you contact the seller prior to picking up the vehicle to determine what Advance Fees you may be required to pay.

AR Direct may reimburse you for such Advance Fees. For reimbursement from AR Direct, you must submit your receipt, accurately reflecting any Advance Fees paid, to AR Direct at info@ar.direct.

VEHICLE DESCRIPTIONS AND DISCLAIMERS

1. Why do some vehicle descriptions include more detail than others? Who provides the vehicle descriptions?

All descriptions, pictures and other representations of vehicles listed on AR Direct are provided by the seller. Such vehicle descriptions, pictures and other representations may vary by vehicle and by seller and may contain inaccuracies and/or errors. NONE OF AR Direct OR IT'S PARENTS OR AFFILIATES MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE ACCURACY OR COMPLETENESS OF ANY SUCH INFORMATION. You are responsible for reading the full item listing, including any instructions the seller provides, before making a bid or commitment to buy.

AR Direct and it's parents and affiliates expressly disclaim the accuracy and/or completeness of any and all information provided to you by seller or otherwise regarding any vehicle, whether provided in written, verbal, or digital image form ("Vehicle Information"). Vehicle Information provided on AR Direct is for convenience only. You shall not rely on Vehicle Information in deciding whether or how much to bid on a vehicle offered for sale through AR Direct.

Vehicle Information includes but is not limited to: year, make, model, condition, ACV, damage amount, damage type, drivability, accessories, mileage, odometer disclosures, vehicle identification number ("VIN"), title, repair history, title history, and total loss history.

2. Are loose parts displayed in the pictures included in the sale?

Some sellers may provide vehicle images or descriptions that include loose parts. Loose parts may be lost/misplaced/detached at storage facilities and/or in transit.

AR Direct and it's parents and affiliates expressly disclaim the accuracy and/or completeness of any and all information provided to you by any seller regarding any vehicle, including loose parts information, whether provided in written, verbal, or digital image form.

3. Does the vehicle start?

The seller may include whether or not a vehicle starts in its listing. AR Direct is not involved in the actual transaction between buyers and sellers, and has no ownership interest in the vehicles offered for sale using its internet auction platform. Vehicle descriptions are posted by the seller, and AR Direct has no knowledge as to their accuracy.

Vehicle Information provided on AR Direct is for convenience only. AR Direct and it's parents and affiliates expressly disclaim the accuracy and/or completeness of any and all information provided to you by any seller regarding any vehicle, whether provided in written, verbal, or digital image form ("Vehicle Information"). You shall not rely on Vehicle Information in deciding whether or how much to bid on a vehicle offered for sale through AR Direct.

4. Why is the posted VIN number incomplete?

Some sellers provide only the first 11 digits of the VIN for decoding purposes. The winner will receive the complete VIN upon payment.

5. I received my vehicle and there are additional damages, undercarriage and other latent defects not visible in the pictures. What can I do?

All vehicles sold through AR Direct are sold "AS-IS WHERE-IS", WITHOUT ANY WARRANTY, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE OR MERCHANTABILITY BY AR Direct OR AR Direct. All representations and warranties, if any, are solely from the seller and it is your sole responsibility to verify any such representations and warranties with the seller prior to purchasing a vehicle.

6. Do you have a repair estimate for a vehicle?

AR Direct does not provide repair estimates. The seller may or may not provide a repair estimate in its description of the vehicle.

7. When I pick up my vehicle there is more damage than displayed in the vehicle images that appears to have occurred after the auction. What can I do?

AR Direct urges you to pick up your vehicle as soon as possible after you purchase and pay for the vehicle. YOU TAKE FULL RESPONSIBILITY AND ASSUME ALL RISK OF LOSS OR DAMAGE FOR ALL VEHICLES PURCHASED FROM THE TIME AR Direct ACCEPTS YOUR BID. At no time is AR Direct, or its parents and affiliates, serving as a bailee. AR Direct and its respective parents and affiliates are not responsible for, and assume no liability for, fire, theft, damage or loss to any vehicle, or for injury to any person or property for any reason.

8. Does the vehicle have keys? How can I obtain a key if the vehicle does not have keys?

Many vehicles from sellers come without keys. Sometimes keys are lost at the storage lot, during moves of the vehicle between and within storage lots, or in transit. AR Direct takes no responsibility for missing keys, and does not guarantee keys are available for any vehicle sold through AR Direct, regardless of whether keys are present in online vehicle images, or were present in the vehicle prior to the time of purchase. If your vehicle does not have keys, you may be able to obtain one as follows:

  1. From the VIN. Contact a local authorized dealer (for your vehicle make) and inquire if a key can be made from the VIN.
  2. From the ignition code. If the local authorized dealer cannot make a key from the VIN, it may be possible to make a key from the code engraved on the ignition. This could require removal of the ignition in order to view the code.
  3. From the ignition. A locksmith may be able to make a key specific to the ignition using your vehicle's ignition.
AR Direct and it's parents and affiliates expressly disclaim any and all representations, warranties, and guarantees regarding vehicles purchased using AR Direct, including but not limited to the inclusion of keys with your vehicle.

 

VEHICLE TITLES

1. How will I receive the title to my vehicle?

The seller will mail the original title directly to you at the address provided on your AR Direct account. The seller is solely responsible for title transfer and AR Direct is unable to provide an estimated time frame for delivery of the title.

2. Can I have the title mailed to an address different than the address on my AR Direct account?

Yes, but any requests for changes to the address must be made to AR Direct in advance by either contacting AR Direct at (850) 260-3087 or emailing us at info@ar.direct. Otherwise the title will be mailed to the address on your account.

3. What do I do with a title for a vehicle sold by insurance carrier?

When a car is sold by an insurance carrier, the insurance carrier will mail the original title from the insured directly to you. It is your responsibility to apply for a salvage certificate (or other title demanded by the insurance carrier) in your state. None of AR Direct or it's parent, subsidiaries or affiliates are not responsible for defects, errors, or omissions (i) related to motor vehicle department paperwork not processed by AR Direct or its parents or affiliates, or (ii) made by any Department of Motor Vehicles ("DMV")/Motor Vehicle Department ("MVD").

You will be reimbursed by AR Direct for any DMV/MVD processing fees. For reimbursement from AR Direct, you must submit your receipt, accurately reflecting any DMV/MVD processing fees paid, to AR Direct at info@ar.direct.

Once you receive a salvage certificate for your vehicle, you must submit a copy to AR Direct at info@ar.directThe vehicle you purchase may NOT be disassembled prior to the salvage certificate obtaining.

4. Why must I submit a copy of the salvage certificate to AR Direct?

AR Direct is required to collect and maintain these records to comply with various statutes and regulations. Therefore, you must submit a copy of the salvage certificate for any vehicle purchased using AR Direct to info@ar.direct.

5. I received a different type of title than the one in the vehicle description on AR Direct, or I received an equivalent title from a different state. Why?

AR Direct has no ownership interest in the vehicles offered for sale using it's internet auction platform and therefore does not guarantee title types. The seller is solely responsible to provide you with the title for any vehicle you purchase. You may receive an equivalent title type to the one in the online vehicle description because of variations in state or local licensing laws and regulations. Differences between title types and/or designations are minor, for example "Arizona Salvage Certificate" is displayed in the online description, but the customer receives a "Nevada Salvage Title". Differences in title type and/or designation bear no change in equivalence.

6. What is a "reconstructed title"?

When a vehicle is involved in an accident and salvaged by the insurance company, it must be reconstructed before being placed back on the road. After the vehicle is repaired, it is inspected by an authorized mechanic and certified by the DMV as reconstructed to manufacturer specifications. The DMV may then issue a "reconstructed" title, which is treated the same as a "clean" title for registration and insurance purposes.

AR Direct is not involved in the reconstruction or titling processes. AR Direct and its parents and affiliates expressly disclaim any and all representations, warranties, and guarantees regarding vehicles sold using AR Direct. AR Direct and its affiliates do not guarantee that vehicles meet or can be modified to meet local emission and/or safety requirements. It is your sole responsibility to ascertain, confirm, research, inspect, and/or investigate vehicles and any and all information regarding the type, condition, status, and history of vehicles prior to bidding on them. Please refer any title questions to your local DMV.

PICKING UP YOUR VEHICLE

1. When can I pick up the vehicle?

You can arrange for pick up/shipping as soon as we receive payment for your vehicle. Purchases should be picked up by the end of the first business day following the day of sale via, or you will incur additional storage fees. For example, if you purchase a vehicle on Tuesday, you must pick up the vehicle by the end of the business day on Wednesday. If you purchase a vehicle on Friday, you must pick up the vehicle by the end of the business day on Monday.

In any event, you must pick up the vehicle by the end of the third business day following the sale, or you will forfeit your right to purchase the vehicle and will incur a substantial Forfeit Fee.

Please note that the address of the vehicle will only be released to you after AR Direct has received full payment for the vehicle. We recommend you pay for your vehicle as soon as possible to allow time to arrange for vehicle pick-up.

2. What happens if I pay for my vehicle but do not pick it up within three business days following the date of sale?

If you fail to pay for a vehicle by the end of the first business day following the day of sale, your AR Direct account will be suspended, you will forfeit your right to purchase the vehicle, and the vehicle will be re-listed for sale. In addition, you will incur a Renege Fee of not less than $1000.00 or 15% of your winning bid, whichever is greater.

In addition, your AR Direct account may be suspended and you may be required to pay the Reinstatement Fee if you wish to continue to use AR Direct.

For example, if you purchase and pay for a vehicle on Monday, but fail to pick up the vehicle by the end of the business day on Thursday, you forfeit your right to purchase the vehicle, the vehicle will be resold without any further reimbursement to you, and you will incur the Forfeit Fee. If you purchase and pay for a vehicle on Wednesday, but fail to pick up the vehicle by the end of the business day on the following Monday, the vehicle will be resold without any further reimbursement to you, and you will incur the Forfeit Fee.

3. What documentation do I need to pick up the vehicle?

To pick up a vehicle, you will need a printed copy of your invoice showing a zero balance. Please confirm that AR Direct has received your payment prior to picking up the vehicle! If the printed invoice does not show a zero balance, the vehicle will not be released to you or to your shipping company.

4. Can I drive a salvage vehicle home?

No, the vehicle will need to be shipped to your designated location.

5. How much does it cost to ship a vehicle?

AR Direct does not ship vehicles, but we highly recommend HaulMatch.com as the leading online vehicle transport matching service offered to both the general public and registered members of select U.S. auction houses.** HaulMatch.com can facilitate domestic and international transport of your vehicle by selecting the optimal carrier at competitive and guaranteed pricing. Each listing on AR Direct site contains a HaulMatch shipping calculator through which you may purchase shipping instantly. Alternately you can go to www.HaulMatch.com or call 866-305-5016.

You may also hire a shipper/broker of your choice. Please note that to receive an accurate shipping quote, you may need to advise your shipper that the vehicle to be transported is inoperable.

When exporting a vehicle from the US, it is important to understand commercial, shipping and legal documentation and processes. Prior to purchase, please make sure your vehicle can be imported into Canada. AR Direct will not reimburse you for a purchased vehicle that cannot be imported into Canada or any other country. Further information can be found at: http://www.riv.ca/english/html/us_vehicle_admissibility.html.
